At the time of this recording, the bill had not yet been enacted. It was later signed into law by Colorado Governor Jared Polis on April 20, 2026.
The law excludes Post Closing Occupancy Agreement (PCOA) arrangements from Colorado’s residential security deposit limits. After the effective date, the law will allow for security deposit amounts untethered to any amount paid for rent where a seller resides in a home some a period of time after closing under a PCOA.
