RESIDENTIAL PROPERTY MANAGEMENT AGREEMENT

The FJGG Residential Property Management Agreement defines the relationship between property managers and property owners, and may be used throughout the State of Colorado.  Since the Colorado Real Estate Commission does not provide a mandatory Commission-approved property management template, our clients utilize our attorney-drafted agreement when managing residential real estate in Colorado.

The Property Management Agreement includes:

  • Selection of management services to be provided, including: (1) marketing and tenant-selection services; (2) entering into leases; (3) managing tenant relationships; (4) contracting for maintenance services; and (5) payment of property-related expenses
  • Compensation, including: (1) leasing commissions; (2) renewal commissions; (3) regular management fees; and (4) minimum management fees
  • Transaction-brokerage or landlord agency representation
  • Establishment and reimbursement of management custodial account
  • Choice of who holds tenant security deposits
  • Detailed property description
  • Owner obligations to keep property in compliance with various laws, regulations and ordinances
  • Owner representations regarding foreclosure, meth labs, carbon monoxide detectors, and HOA’s
  • Manager-oriented termination and cancelation provisions
  • Manager indemnification by owner
  • Term of engagement
  • Effect of listing or sale
