Hopefully you never receive a dreaded IRS tax notice in the mail. IRS tax notices can be hard to interpret and even harder to know how to resolve. This is where we can help. In choosing the correct tax professional to represent you before the IRS, it is important to understand the different types of tax practitioners. A tax professional may have “unlimited representation rights” or “limited representation rights.” Those with unlimited rights may represent their clients on any matters including audits, whereas those with limited rights may only represent clients for whom they prepared and signed their tax return and then only before certain departments and individuals of the IRS.

Which types of tax professionals have these unlimited rights?

Attorneys (Esq.) – Licensed by state courts or state bars and have earned a degree in law and passed a bar exam. They must meet ongoing continuing education and professional ethical standards.

Certified Public Accountants (CPA) – Licensed by the state board of accountancy and have passed the Uniform CPA Examination. They must comply with ethical requirements and complete specified levels of continuing education.

Enrolled Agents (EA) – Licensed by the IRS by passing a suitability check and a three-part Special Enrollment Examination. They demonstrate proficiency in federal tax planning and representation. They must complete 72 hours of continuing education every 3 years.
