Mediation Services
In addition to offering our clients’ assistance with multiple areas of law and legal services, the law firm of Frascona, Joiner, Goodman and Greenstein, P.C. (“FJGG”) is now also offering mediation services for various types of disputes.
Mediation is a process used to resolve a myriad of conflicts within a variety of settings. Mediation is a confidential process in which an impartial third party facilitates communication and negotiation and promotes voluntary decision making by the parties to the dispute. While mediation does not result in the mediator making a decision regarding which party’s position is legally or morally correct, with the parties’ cooperation, mediation can result in a compromise whereby the parties may avoid costly litigation. At a minimum, even if the parties participating in mediation are unable to resolve their disputes and reach a mutually satisfactory agreement, the parties will in almost cases learn valuable information about the issues in dispute, which will hopefully help facilitate a resolution to the parties’ issues at a later date.
FJGG’s mediation services include mediations at various stages of the dispute, encompassing court ordered mediations or pre-litigation mediation services, and including the following subject areas: earnest money disputes, general real estate disputes, construction disputes, contract disputes, collection disputes, domestic disputes, bankruptcy adversary proceedings, homeowners’ association disputes, landlord/tenant disputes, neighborhood disputes, dog barking disputes and more.
FJGG understands that different types of disputes come in different boxes with various levels of complexity and money involved. Therefore, FJGG is offering standard court ordered mediation with both parties’ and their attorneys present, in addition to offering traditional mediation between parties only in certain scenarios. For example, in addition to court ordered mediations in civil disputes where attorneys customarily attend mediation with their clients, FJGG is also committed to providing private party mediation options, with the consent of the parties, for disputes involving relatively lower dollar amounts, such as an earnest money dispute in many cases; this option may not make sense in all scenarios; however, some parties may choose and consent to mediating a lower dollar dispute without their own attorney present in order to limit their expenses given the overall amount in controversy.
